The NSW government says any inquiries including one into alleged branch-stacking involving a brother of Premier Dominic Perrottet can continue despite parliament being shut down from Monday.

Labor seized on a notice published in the government gazette on Thursday that said the state’s upper house would be prorogued, meaning shut down, from Monday.

The government insisted it was procedural after Labor raised concerns the move could stop further inquiries into missing Liberal Party operatives or its final report into the John Barilaro trade scandal.

A spokesperson for the premier said proroguing the parliament was an entirely normal process that occurs before every election and that the timing was comparable with previous general elections.

“Labor are focused on political games and should be ashamed of the lies and scare tactics they are undertaking,” he said.

When Labor prorogued parliament ahead of the 2011 election, then opposition leader Barry O’Farrell described it as a denial of democracy. The move was hugely controversial and Coalition governments have since not prorogued until closer to election day.

Retiring transport minister David Elliott told 2GB’s Chris O’Keefe on Thursday afternoon that he had not been briefed on parliament shutting down but said, “[former Labor premier] Kristina Keneally did it to get some barnacles off her government”.

Prior to the 2019 NSW election, the parliament was prorogued from February 25, 2019, while Keneally prorogued the parliament on December 22, 2010, more than three months before the election in 2011. Upper House committees continued to sit after this date.

Ahead of the premier’s statement, Labor leader in the upper house Penny Sharpe told O’Keefe that the government needed to provide clarity on the effect of the gazette.

“This has come out of left field, we were not anticipating this, there are still some questions we need answered and I think the government needs to provide some clarity,” Sharpe said. “This is important because there is a lot of work still to happen in the next seven days.”
